PERSONAL DATA PROTECTION POLICY (PDPA)

AGHRM Malaysia Sdn Bhd recognises the critical importance of Personal Data Protection and commits to properly manage, protect and safeguard clients’ Personal Data and information, in accordance with Personal Data Protection Laws [PDPA].

This Policy details how AGHRM Malaysia Sdn Bhd collects, uses, discloses and/or processes Personal Data and Information of Clients:

(i) Personally identifiable information under Personal Data Protection Law and any other applicable Data Protection laws.
(ii) Personal Information including name, physical addresses, email address, telephone number, photograph, account number, passport, or identification number.
(iii) Other information relating to or associated with such personally identifiable information e.g.

(a) Screenshots, video images, date of birth, medical records, biometric information i.e. fingerprints, facial images and any other Personal Information which you have provided to us.
(b) Information pertaining to Online interactions with AGHRM Malaysia Sdn Bhd such as cookies, IP addresses, browsing history etc.
(c) Bank account details, credit card information and history.By submitting Personal Data and information to AGHRM Malaysia Sdn Bhd, visiting any of AGHRMS websites or using our Cloud HR Software, visitors, clients and users are deemed to have accepted all terms set out in this Policy.

IMPORTANT: Because AGHRMS is hosted on our Cloud servers in Singapore, all Personal Data collected in Malaysia, will be stored in our Data Center in Singapore.

(a) Register their personal details with AGHRM Malaysia Sdn Bhd.
(b) Enter into any agreement or provide other documentation or information in respect of their interactions with us.
(c) Submit Personal Data upon entering the physical location of, or via photographs or videos taken by AGHRM Malaysia Sdn Bhd.
(d) Complete purchase of AGHRMS (MY) products and services in-person or electronically.
(e) Interact with AGHRMS (MY) or AGHRM Malaysia Sdn Bhd regarding our products and services via telephone calls, direct mails, face-to-face meetings, social media, or other means possible.
(f) Subscribe to AGHRMS (MY) products and services, or maintenance and post-sales services.
(g) Perform payments or other business-related transactions through AGHRMS (MY) or AGHRM Malaysia Sdn Bhd.
(h) Interact with AGHRM Malaysia Sdn Bhd online and offline.
(i) Are referred by business partners, public agencies, ex-employers, intermediaries, and any third parties or other authorities.
(j) Submit Personal Data for other reason(s). AGHRM Malaysia Sdn Bhd may also collect information about the computer, mobile phone, or other devices use to access AGHRMS (MY) on all platform(s) possible.

AGHRM Malaysia Sdn Bhd does not collect Personal Data unless provided by clients. If clients provide AGHRM Malaysia Sdn Bhd with any Personal Data relating to a third party, by submitting such information, they are deemed to have obtained prior consent to do so.
Even when consent is not granted, AGHRM Malaysia Sdn Bhd may collect and use Personal Data under the following circumstances:

(a) For emergencies that threaten the life, health, and safety of individuals.
(b) For investigations, law enforcement, Litigations, or legal proceedings
(c) For requests from the public, government authorities, and other relevant bodies or agencies.
(d) For national security or issues of public interest or importance.
(e) For other exceptions or exemptions as deemed critical and necessary.

 Provide products & services to clients, including tasks relating to the provision of services.
(c) Process payments and commercial transactions of products & services.
(d) Establish and verify identity of persons.
(e) Respond to requests, feedback, or resolve technical support and customer issues arising from liaison with AGHRM Malaysia Sdn Bhd.
(f) Inform clients of any marketing activities e.g. workshops, promotions, and other updates.
(g) Update and maintain records accuracy and completeness.
(h) Manage, plan & administrate operations while in compliance with internal policies and SOPs.
(i) Where applicable, share the client’s Personal Data pertaining to any document which the client has duly entered into, for seeking legal advice or commencing legal proceedings.
(j) Carrying out investigation and initiatives to prevent fraud, illegal activities, prohibited practices, disputes, offenses, legal prosecution or managing commercial risks.
(k) Enable AGHRM Malaysia Sdn Bhd to fulfill obligations and enforce rights under any current-binding agreements.
(l) Assign or transfer rights, interests, and obligations under any current-binding agreements with AGHRM Malaysia Sdn Bhd.
(m) Fulfil compliance with current statutory or legal requirements and making authorized disclosure under applicable laws, Orders of Court, rules, guidelines.
(n) Defend or enforce company and client’s rights.
(o) Operate and manage relationships with the clients and relevant third parties.
(p) Facilitate business transactions, which include mergers and acquisitions or asset sales.
(q) Identify the required person(s) for any of the above-mentioned purposes.
(r) Manage safety and security of AGHRM Malaysia Sdn Bhd premises and services which includes CCTV surveillance and imposing of security clearances.
(s) Monitor or record tele-conversations and face-to-face customer interactions for quality assurance, training purposes, performance evaluation and verification of identity.
(t) *Pertaining to any claims, proceedings, or actions including drafting agreements and contracts, reviewing documentation, maintaining records of transactions, operating procedures, obtaining legal advice, resolving disputes, and enforcing rights and contractual terms.AGHRM Malaysia Sdn Bhd may also collect and use client Personal Data as follows:

  • To process and maintain customer account.
  • To process requests, including creating and maintaining user records in a secure database.
  • To Administer Debt Management.

Employees, external contractors or authorized third-party providers of client companies shall:

(a) Do their due diligence verifications and checks.
(b) Access and evaluate suitability as a vendor, contractor, and external service provider for AGHRM Malaysia Sdn Bhd and to conduct the required background checks.
(c) Create and maintain information of external contractors and service providers.
(d) Process requests and expedite necessary actions for fulfilling work tasks and engagements of employees and external contractors.
(e) Respond to emergencies and unexpected events, and acts of God.
(f) Communicate to relevant stakeholders, after awarding of the contract, who are required to carry out work tasks, and to address security concerns.In addition, AGHRM Malaysia Sdn Bhd may also collect and use Personal Data for:
(i) Taking testimonials, images e.g. logos, photographs, and videos for marketing, publicity, and advertising in Online and Offline channels of AGHRM Malaysia Sdn Bhd.
(ii) Updating prospects and clients on upcoming products, services, and benefits, including promotions, software enhancements, and other useful information.
(iii) Implementing events, campaigns, and other required initiatives to boost company business performance, while benefitting prospects and clients at the same time.
(iv) Analyse and understand the market, competition, and customer behavior, demographics to determine evolutionary trends, so as to better serve clients and target markets.
(v) Developing new products, services, and joint-launching marketing and publicity initiatives.*By providing Personal Data e.g. Name, Contact Number, and Email Address, clients and prospects agree to receiving communication (including voice calls, text or via other common channels),

Marketing updates from AGHRM Malaysia Sdn Bhd. This shall be the default, unless explicitly informed otherwise by clients and prospects, via sales@aghrm.com.

AGHRM Malaysia Sdn Bhd commits and undertakes to protect Personal Data under its care and control by ensuring all security measures are in place to prevent unauthorized access.

(a) Authorized third-party service providers, engaged for any of the above-mentioned purposes.
(b) Employees of AGHRM Malaysia Sdn Bhd, in carrying out their duties with resolving support issues and inquiries relating to AGHRMS (MY) Cloud HR Software.
(c) Partners, investors, assignees in facilitating transactions e.g. mergers & acquisitions etc.
(d) Government authorities which include law enforcement (local or overseas), as required for compliance with any legal directions, rules, guidelines, regulations or schemes administered
(e) Other parties authorized by the client.

(a) Request a copy of this Personal Data Protection Policy [PDPA].
(b) Request in writing, to correct or update their Personal Data that AGHRMS (MY) holds. AGHRM Malaysia Sdn Bhd shall respond within 30 days upon receipt of such requests.

At the same time, AGHRM Malaysia Sdn Bhd reserves the right to decline requests which can potentially jeopardize the privacy and security of Personal Data and Information of others.

The above-said shall apply as well as for requests which are not made in good faith, unfeasible or impractical. AGHRM Malaysia Sdn Bhd may or may not charge a processing fee or deposit, depending on the scope of works required.

Where such fees & deposits are to be imposed, AGHRM Malaysia Sdn Bhd will inform the client accordingly.

Under PDPA laws of Malaysia, clients reserve the right to withdraw consent for the collection, use of and/or disclosure of their Personal Data in AGHRMS (MY)’s possession, for any of the above-listed purposes at any time, by submitting a request in writing to sales@aghrm.com.

Upon receiving a written request to withdraw consent, AGHRM Malaysia Sdn Bhd requires reasonable time, to process such requests and notify the client of any outcomes, including any consequences (legal or non-legal) possible.

If a client(s) withdraws consent to partial or all use of their Personal Data, AGHRM Malaysia Sdn Bhd may not be in a position to continue its products and services to the said client,

Which could also result in termination of any prior agreements with AGHRM Malaysia Sdn Bhd, and being in breach of any contractual obligations.

NOTE: Withdrawing consent does not affect AGHRM Malaysia Sdn Bhd in continuing to collect, use and disclose Personal Data where such collection, use, and disclosure without consent is permitted or required under applicable laws.

To ensure that client’s Personal Data & Information remains current, accurate, and complete, the client must update AGHRM Malaysia Sdn Bhd of any changes via sales@aghrm.com.

AGHRMS (MY) shall treat all clients’ Personal Data & Information as true, accurate and complete until informed otherwise by the client.AGHRM Malaysia Sdn Bhd may retain the client’s Personal Data for as long as the purposes for which such data was collected, required by applicable laws, or deemed necessary for use.

Personal Data and Information may be stored in servers located overseas. Where absolutely necessary during the course of our business operations,

AGHRM Malaysia Sdn Bhd may need to transfer client Personal Data between our subsidiaries and authorized third-party service providers, some of whom might be located outside of Malaysia.E.g. Under explicit permission via writing from the client, client Personal Data stored in AGHRMS (MY) software may be transferred overseas for support functions.

The said transfer shall be in accordance and compliance with Malaysian PDPA laws in ensuring that companies uphold maximum protection standards to Personal Data and Information.

AGHRMS (MY) uses cookies and similar technologies for collecting and storing information to provide visitors and users with a faster and safer and better website navigation experience.

Information collected by AGHRMS (MY) or authorized service providers might recognize a visitor or repeat user as ‘unique’ and may collect information such as:

  • How a visitor, prospect or user arrives at our Platform
  • What operating system or internet browser the said visitor and prospect is on,
  • What is the said visitor, prospect or user’s IP address
  • What pages the visitor, prospect or user has accessed and time spent on each webpage.

AGHRMS (MY) uses cookies and similar technologies which are necessary for smooth functioning, improving performance or provide additional functionalities for the client.

Cookies are small text files located in the browser upon visiting a website. Cookies allow a website to recognize a particular device or browser. There are different types of cookies e.g.:

  • First-party cookies are stored by a website in a new browsing session by a new visitor.
  • Session cookies expire at the end of a browser session and allow the website owner to link actions taken by the visitor or end-user during the said browser session.
  • Persistent cookies remember a client’s / visitor’s preferences or actions across multiple websites on a specific device.

Cookies can be removed or disabled in most commercial browser settings.

Similar Technologies refer to technologies that store information in your internet browser or device using local shared objects e.g. HTML 5 cookies and other web applications means.

Web Beacons refer to very small graphic images or objects that track the online actions and activity of users on an HTML webpage.AGHRM Malaysia Sdn Bhd might use “Cookies” or “Similar Technologies” interchangeably when referring to any technology that is used to collect or store information in your browser or device, in identifying “Unique” and Repeat Users.

Certain services, site elements in AGHRMS (MY) HR Software platform, are available only via these technologies. Hence by disabling cookies or similar technologies, the end-user might not be able to maximize the use of AGHRMS (MY) Cloud HR Software.

AGHRM Malaysia Sdn Bhd shall not be held responsible for the data protection of third-party websites that might be linked to AGHRMS (MY) HR Software platform in one way or another.

It is for the client to learn about the data protection practices of such websites, some of which may contain our logo/trademark, even if they are not related to AGHRM Malaysia Sdn Bhd.

For clients who unsubscribe from AGHRMS (MY), it is for them to check the Privacy Policy of any third-party website in understanding how their Personal Data & Information will be handled.

Should client Personal Data be provided to AGHRM Malaysia Sdn Bhd via a third party, it is for the client to contact that company or individual(s), in making inquiries, lodging complaints, or other requests to AGHRM Malaysia Sdn Bhd.

In ensuring this policy is always consistent and up to date with current statutory & legal laws requirements, AGHRM Malaysia Sdn Bhd reserves the right to modify or amend the terms stated in this policy, as deemed critically and absolutely necessary without prior notice.

By using AGHRMS (MY), the client hereby agrees to be bounded by all current prevailing terms & conditions indicated in this PDPA Policy.

Clients are urged to visit the AGHRMS (MY) website ensuring they are updated of any latest updates to any policies & statutory updates pertaining to Personal Data Protection (PDPA) in Malaysia.

This policy shall be governed by the statutory laws of Malaysia.
